Parents in California could lose custody of their children to another parent or even the state itself if they resist their kids’ desire to undergo gender alteration through hormone therapies or child mutilation surgeries, according to the state’s legislative body.
The Golden State legislature passed Assembly Bill 957, titled “Transgender, Gender-Diverse, and Intersex Youth Empowerment Act,” on Friday, September 8, by a party-line vote of 57-16, with several Democrats not voting. It was previously approved by the California Senate with a vote of 30-9.
The new legislation claims to “prioritize the health, safety and welfare” of children, which gives high emphasis on “affirming” a child’s gender identity. AB 957 was initially proposed by Democratic Assemblywoman Lori D. Wilson on February 24 to require courts to consider whether parents were “affirming” a child’s identification as transgender in custody cases. The legislation was later amended in June to declare parents who aren’t deemed sufficiently “in favor” to be even liable for child abuse. For Wilson, gender affirmation could also mean letting a child play with toys associated with his or her gender identity, getting nails painted, or wearing his or her hair at a desired length. But the main emphasis is on the parents’ “affirmation” if ever a child announces he/she wants to alter his/her genitals.
The bill’s supporters argue that it is in the best interest of children. However, gender alteration surgeries in California can only be availed by minors if they have parental consent. “In most cases, youth under the age of 18 must obtain the permission of their parents or guardian to access any medical treatment, including treatment for gender transition,” the California Transgender Law provides. Also, state law already bars custody courts from considering a parent, legal guardian, or relative’s sex, gender identity, gender expression or sexual orientation when determining the best interests of a child. This makes the said legislation “illegal.”
Meanwhile, the California Catholic Conference, the state’s official public policy voice of the Catholic Church, opposes the bill.
“We strongly support parents affirming the goodness of their children and compassionately caring for children with gender dysphoria,” the conference said in a legislative report on its website. “Our concern is that this bill places a thumb on the scale for custody against loving, protective parents that lacks sufficient data to be warranted. Rather than driving a wedge between children and parents, it is in the best interest of children to promote parental communication and involvement,” the conference’s analysis said.
Moreover, the opposition raised concerns about the law infringing upon parental rights and autonomy. Critics view this as a government overreach.
Republican state Sen. Scott Wilk even bluntly recommended parents to “flee” the state because of the recent developments on the AB 957. “In the past when we’ve had these discussions and I’ve seen parental rights atrophy, I’ve encouraged people to keep fighting,” Wilk said back in June. “I’ve changed my mind on that. If you love your children, you need to flee California. You need to flee.” The senator also even vowed to leave the state himself at the end of his term.
The said legislation is now headed to the desk of Gov. Gavin Newsom, who is expected to sign it. For Big Tech magnate Elon Musk, the bill is “a wolf in sheep’s clothing.” He turned to his platform X, formerly known as Twitter, and posted: “What it [AB 957] would actually mean is that if you disagree with the other parent about sterilizing your child, you lose custody. Utter madness!”
It is no secret that Musk has a transgender child, the 19-year-old Xavier, who was born a biological male and now carries the name Vivian Jenna Wilson. Their relationship has been shaky and considered irreparable. He called his son a “communist” and slammed the prestigious and expensive Crossroads School for Arts and Sciences in Santa Monica, California, which by the way charges $50,000 per student annually, for brainwashing his child to despise the wealthy and “infecting him with the woke mind virus.” (Related: Musk slams expensive California school for infecting his transgender son with “woke mind virus.”)
In an excerpt from the upcoming biography of the Twitter and Tesla CEO published in the Wall Street Journal, he revealed that he was actually in favor of his child’s gender transition at first. However, in April 2022, Wilson severed all relations with him and refused to be a part of his life because of the takeover of elite institutions by left-wing academics.
“Unless the woke mind virus, which is fundamentally anti-science, anti-merit and anti-human in general, is stopped, civilization will never become multi-planetary,” Musk said. He also blamed “neo-Marxist” colleges for the rift between himself and his kid.
